This site is created to facilitate trip giveaways and merchandise orders expressly for fundraising opportunities. Individual users of this site shall henceforth be referred to as ("Customers"). Schools and Parent Teacher Associations or Organizations (PTAs/PTOs) and other governing bodies shall henceforth be referred to as ("Clients"). Official merchandise licensees shall be referred to as ("Vendors").

In order to execute an online transaction and purchase from this Site, you verify that you are over 18 years of age or have the consent of a parent or guardian to make the purchase and are approved to use a credit card for the purchase. IF YOU ARE A PARENT OR GUARDIAN AND YOU PROVIDE CONSENT TO YOUR CHILD’S PARTICIPATION AND USE OF THIS SITE, YOU AGREE TO BE BOUND BY THESE TERMS OF USE IN RESPECT TO THEIR USE OF THE SITE.
You acknowledge that these terms of use are supported by reasonable and valuable consideration, the receipt and adequacy of which are hereby acknowledged. All trademarks, service marks and trade names used on this Site are proprietary to us and/or our Vendors and may not be used, reproduced, transmitted or redistributed without express written permission.
It is understood that all purchases are part of a fundraiser. As such, once a confirmation has been issued through this Site, there will be no refunds, returns or exchanges of any type whatsoever. It is the responsibility of the Customer to supply and verify accurate ordering information including the full name of recipient, address and credit card information for ordering and shipping purposes.
Subject to the requirements of applicable consumer rights and other laws, these terms of use shall be governed by and construed in accordance with the laws of the State of North Carolina and the laws of the United States, without giving effect to any principles of conflicts of law. If any provision of these terms of use shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these terms of use and shall not affect the validity and enforceability of any remaining provisions.
1. Fundraiser Description:
All ‘Fundraisers' ("Fundraisers") are designed to help pet shelters/humane societies/SPCAs, schools/PTAs/booster clubs, youth sports/band/dance teams and other non-profit organizations raise funds through the sale of officially licensed pro team (MLB, NBA, NFL, NHL) and college (NCAA) pet merchandise.
The 'Owner' of the Fundraisers is AES Consultants, LLC. Individual participants of these Fundraisers shall be referred to as ("Customers"). Participating pet shelters and animal humane societies shall be referred to as ("Clients"). Official merchandise licensees shall be referred to as ("Vendors").
By participating in the Fundraisers, Customers and Clients unconditionally accepts and agree to comply with and abide by the Official Rules and the decisions of Owner, which shall be final and binding in all respects. Owner is responsible for all aspects of the Fundraisers, including but not limited to the maintaining the Site, collection of funds, processing of orders, distribution of proceeds to Clients, as well as the overall administration of the Fundraisers. Customers and Clients should look solely to Owner for answers to any questions, comments or problems related to the Fundraisers. Owner may be reached by email at [email protected].
2. Legal and Financial:
The Fundraisers are open to legal residents of the United States, (excluding U.S. Territories), who are at least 18 years of age, on or before August 1, 2020. This Fundraisers are subject to all applicable federal, state and local laws and regulations and is void where prohibited or restricted by law. Orders will be nullified, at the sole discretion of Owner, if attempts are made to disrupt the Fundraisers or circumvent the terms and conditions of these official rules. If the above occurs, Owner reserves the rights to remedy any such action, disruptions, or circumvention in a manner, determined by Owner and in conjunction with the participating Client, in a manner that is fair and equitable to all parties.
If Customer's payment is dishonored for any reason, the corresponding order will be cancelled, until a valid payment is made. A $35.00 charge will be assessed for non-sufficient funds.
3. Tax Considerations:
All purchases as part of the Fundraisers are subject to the requirements of applicable consumer rights and other laws, whose terms of use shall be governed by and construed in accordance with the laws of the State of North Carolina and the laws of the United States, without giving effect to any principles of conflicts of law. If any provision of these terms of use shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these terms of use and shall not affect the validity and enforceability of any remaining provisions.
The IRS has taken the position that amounts paid for merchandise are not gifts and therefore, the price of the merchandise does not qualify as a deductible charitable contribution.
4. Privacy:
Any personal information supplied by Customers will be subject to the
privacy policy of the Owner posted at www,gametimefundraisers.com.
By purchasing product as part of the Fundraisers, you grant Owner permission to share your email
address and any other personally identifiable information requested by Clients for the purpose of administrative and bookkeeping purposes.
5. Limitation of Liability:
Owner assumes no responsibility or liability for (a) any incorrect or inaccurate entry information, or for any faulty or failed electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Fundraisers; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, camera, computers or providers utilized in any aspect of the operation of the Fundraisers; (d) inaccessibility or unavailability of any network or wireless service, the Internet or website or any combination thereof; (e) suspended or discontinued Internet, wireless or landline phone service; or (f) any injury or damage to participant's or to any other person’s computer or mobile device which may be related to or resulting from any attempt to participate in the Fundraisers or download of any Fundraisers materials.
If, for any reason, the Fundraisers are not capable of running as planned for reasons
which may include without limitation, infection by computer virus, tampering,
unauthorized intervention, fraud, technical failures, or any other causes which
may corrupt or affect the administration, security, fairness, integrity or
proper conduct of this Fundraisers, the Owner reserves the right at its sole
discretion to cancel, terminate, modify or suspend the Fundraisers in whole or in
part. In such event, Owner shall immediately suspend all orders, and Owner reserves the right to refund Customers based on retail value of product purchased. Owner and any associated vendors shall not have any additional liability to Customers or Clients in connection with the Fundraisers.
Customers release AES Consultants, and its respective board, committee members, officers, volunteers, employees and representative agents from any and all liability with respect to participation in the Campaign. Any liability of AES Consultants shall be limited to the retail price paid for merchandise.
